1. Definitions

For the purposes of these Terms of Sale & Use:

Store means the online store available at www.alternativelongboards.com.

Seller means Alternative Boards sp. z o. o.

Customer means any natural person, legal person, or organizational unit using the Store or placing an order through the Store.

Consumer means a natural person acting for purposes outside their trade, business, craft, or profession, where applicable under mandatory law.

Goods means products offered for sale in the Store.

Sales Contract means a distance contract for the sale of Goods concluded between the Seller and the Customer through the Store.

2. General Provisions

These Terms of Sale & Use apply to all use of the Store and to all orders placed through the Store.

The Store is operated in Polish and English. In case of discrepancies, the version designated by the Seller as controlling for legal purposes shall apply, subject to mandatory consumer protection law.

Prices displayed in the Store are gross prices and include VAT, unless expressly stated otherwise.

The Seller may change prices, introduce new products, remove products, or introduce promotions before an order is placed. Once an order has been placed and accepted, the price of the ordered Goods will not be changed, except where mandatory law provides otherwise.

Promotions, discounts, and special offers may be subject to separate terms, stock limits, or time limits. Where applicable, details of a promotion will be shown in the Store.

3. Store Use and Order Placement

Orders may be placed through the Store 24 hours a day, 7 days a week, subject to technical availability.

To place an order, the Customer selects the Goods, adds them to the cart, proceeds to checkout, provides the required order and delivery information, chooses the available delivery and payment method, accepts these Terms of Sale & Use and other required statements, and confirms the order using the checkout button available in the Store.

Before placing an order, the Customer should verify that all information provided is complete and accurate.

Placing an order constitutes an offer by the Customer to conclude a Sales Contract with the Seller.

After receiving the order, the Seller will send an order confirmation by email. The Sales Contract is concluded when the Seller accepts the order for execution, unless the Store checkout process or mandatory law provides otherwise.

The Seller may contact the Customer in order to verify order details where reasonably necessary for the proper execution of the order.

If the Seller cannot accept or fulfil an order, including due to product unavailability or incorrect order data, the Seller will inform the Customer without undue delay and, where payment has already been made, will refund the relevant amount without undue delay using the same payment method, unless the Customer expressly agrees otherwise.

4. Payment

The Customer is obliged to pay the full price of the order, including any applicable delivery costs shown during checkout.

Available payment methods may include:

The final amount payable by the Customer is shown before the order is placed.

The Seller may issue a VAT invoice or other accounting document in accordance with applicable law.

5. Delivery

The Seller delivers Goods within Poland, within the European Union, and to selected destinations outside the European Union, subject to availability and delivery options shown in the Store.

Estimated delivery times are indicated in the Store or for specific products. Delivery times are estimates and may vary depending on the product, destination, carrier, and circumstances beyond the Seller’s reasonable control.

Where an order includes Goods with different lead times, the longest indicated lead time may apply to the whole order, unless the Seller and Customer agree otherwise.

For certain made-to-order or backorder products, including boards marked as such, the lead time may be longer, including approximately 6 to 12 weeks where indicated in the Store.

Delivery costs are borne by the Customer unless otherwise stated in the Store.

The Customer should inspect the parcel upon delivery to the extent reasonably possible. If the parcel is visibly damaged, the Customer should, where possible, document the damage and contact the carrier and the Seller without undue delay.

6. Returns and Right of Withdrawal

If the Customer is a consumer and mandatory law grants a right of withdrawal from a distance contract, the Customer may withdraw from the Sales Contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which the Customer, or a third party other than the carrier and indicated by the Customer, acquires physical possession of the Goods.

To exercise the right of withdrawal, the Customer should send an unequivocal statement of withdrawal to the Seller by email at sales@alternativelongboards.com

The Customer may use a withdrawal form if one is provided by the Seller, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for the Customer to send the withdrawal statement before the 14-day period expires.

In the event of withdrawal, the Seller will reimburse all payments received from the Customer, including the cost of the least expensive standard delivery option offered by the Seller, without undue delay and no later than 14 days from the day the Seller is informed of the withdrawal. The Seller may withhold reimbursement until the Goods are received back or until the Customer provides evidence of having sent the Goods back, whichever occurs first, unless the Seller has offered to collect the Goods.

The reimbursement will be made using the same payment method used by the Customer in the original transaction, unless the Customer expressly agrees otherwise and does not incur any fees as a result.

The Customer should send back or hand over the Goods without undue delay and no later than 14 days from the day on which the Customer informed the Seller of the withdrawal.

The direct cost of returning the Goods is borne by the Customer, unless mandatory law provides otherwise or the Seller has expressly agreed to bear that cost.

The Customer is liable only for any diminished value of the Goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Goods.

The right of withdrawal does not apply where excluded by mandatory law, including in particular for non-prefabricated Goods made to the Customer’s specifications or clearly personalized Goods.

7. Complaints and Non-Conformity of Goods

The Customer may file a complaint if the Goods are defective, damaged, or not in conformity with the contract, in accordance with applicable law.

To help process the complaint efficiently, the Customer should provide details of the order, a description of the issue, and, where possible, photographs or other supporting information.

The Seller will review the complaint and respond within the time required by applicable law.

If the complaint is justified, the Seller will take the appropriate measures required by applicable law, which may include repair, replacement, price reduction, refund, or other remedies available to the Customer.

Nothing in these Terms of Sale & Use limits any mandatory statutory rights of consumers.

8. Product Information and Availability

The Seller makes reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications, prices, and availability information are accurate and up to date.

Some products may be handmade, custom-made, or made from natural materials. As a result, minor differences in colour, pattern, shape, or finish may occur and do not necessarily constitute a defect.

Product availability shown in the Store may change before the order is accepted.

9. Customer Obligations

The Customer is required to use the Store in a lawful manner and in a way that does not interfere with its functioning.

The Customer must not provide unlawful content, inaccurate data, or act in a manner that infringes the rights of the Seller or third parties.

10. Intellectual Property

All content available in the Store, including texts, product descriptions, graphics, photos, logos, trademarks, layout elements, and other materials, is protected by copyright, trademark rights, or other applicable intellectual property rights.

Unless otherwise permitted by law, copying, distributing, publishing, or using such content for commercial purposes without the prior written consent of the Seller or the relevant rights holder is prohibited.

11. Personal Data and Cookies

Rules regarding the processing of personal data are described in the Privacy Policy.

12. Limitation of Liability

Nothing in these Terms of Sale & Use excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection law.

To the maximum extent permitted by law, the Seller shall not be liable for interruptions in the operation of the Store caused by force majeure, technical failures beyond the Seller’s reasonable control, unlawful acts of third parties, or incompatibility of the Customer’s technical infrastructure with the Store.

This clause does not affect the Seller’s liability for non-conformity of Goods with the contract or any other mandatory rights of consumers.

13. Governing Law and Dispute Resolution

These Terms of Sale & Use and Sales Contracts are governed by Polish law, subject to mandatory provisions of the law of the country of the consumer’s habitual residence where such provisions apply.

Any disputes arising from these Terms of Sale & Use or Sales Contracts shall first be addressed amicably.

Where amicable resolution is not possible, disputes shall be resolved by the competent court in accordance with applicable law.

If the Customer is a consumer, nothing in these Terms of Sale & Use deprives the Customer of any protections granted by mandatory law or of access to competent consumer dispute resolution mechanisms where available.

14. Changes to the Terms of Sale & Use

The Seller may amend these Terms of Sale & Use for important reasons, including changes in law, regulatory requirements, payment or delivery methods, technical changes to the Store, or changes in the Seller’s business operations.

The current version of the Terms of Sale & Use will be published on the Store website.

Changes do not affect orders placed before the amended Terms of Sale & Use entered into force, unless mandatory law requires otherwise.
